Verifone, Inc. and its direct and indirect parent and subsidiary companies (collectively, "Verifone", "Company", or "We"), provide this privacy notice ("Notice") to describe our practices as a data controller regarding the collection, storage, use, disclosure, and other processing of individually identifiable information directly or indirectly identifying you or other individuals relating to your organization ("Personal Information").

If you or your organization have a business relationship or otherwise share Personal Information with a Verifone entity in the excluded countries listed above, the relevant privacy notice provided in the left-hand menu under the 'Country Specific Notices' section governs the Personal Information collection and processing activities of that Verifone entity.

1. Personal Information Collected

We primarily have relationships and accounts only with corporations and other legal entities. However, we may collect Personal Information about individual representatives of our customers:

Personal Information you provide to us when you:

  • Visit our website;
  • Complete a form on our website;
  • Contact us by email, telephone, mail, or other means;
  • Request a quotation, support, downloads, or information;
  • Purchase a product, service, or solution;
  • Create or manage an account;
  • Register or activate a device (e.g., payment terminal);
  • Apply for financing or commercial credit;
  • Register for events, webinars, or services;
  • Subscribe to newsletters, event notices, or information materials;
  • Participate in surveys, webinars, contests, or other promotional activities;
  • Visit our website.

The types of Personal Information we may collect will generally be apparent to you at the time you provide it, and may include:

  • Work contact details: such as name, work address, phone number, mobile phone number, email address, and online contact details, including but not limited to unique identification and password for access to our website, mobile applications, and/or social media features.
  • Position description: such as employer, title, position held.
  • Authentication data: such as passport, driver's license, other governmental identification information, home address and telephone number, documents that verify address, date of birth, country of domicile, documents that verify employment, marriage certificate (if you act as a personal guarantor), and signature authorization.
  • Background check data: such as background check information, including credit and criminal checks and screening, to the extent required or permitted by local law.
  • Financial data: such as credit or payment card number, bank account number, billing address.
  • Surveillance data: such as images and voices captured by CCTV video and audio surveillance equipment installed (to the extent permitted by local law) onto the business premises of a Verifone entity, if you visit our business premises.
  • Electronic and voice communications data: such as content, data, recordings, IP addresses and session identification data relating to business communications with Verifone through all applicable communication channels, including email, text messages (SMS) you send to or receive from our customer support numbers, consent/opt-in and opt-out records (e.g., date/time, method, and content of consent), and basic messaging metadata (such as timestamps, delivery status, and carrier information), instant message or chat, transcriptions, telephone communications, audio or video calls, voice recordings, video recordings, and presentations hosted by Verifone.

If you choose to participate in one of our online surveys, which we conduct to better understand the needs of our customers, we may request additional categories of Personal Information from you.

Amongst the above Personal Information, some of them may be considered sensitive under the data protection laws applicable to the Verifone entity with which you have a business relationship. What constitutes sensitive Personal Information depends on the applicable data protection law, but examples of sensitive Personal Information may include state identification card, passport number, online identifiers, precise geolocation, certain types of customers' financial or account information, etc. Unless stated otherwise, references to Personal Information in this Notice include sensitive Personal Information. However, sensitive Personal Information will be processed in accordance with applicable data protection laws, and only where processing is necessary to achieve the purposes described in this Notice.

Personal Information we collect automatically

In addition to the Personal Information you provide us, our web servers automatically collect certain internet and electronic network activity information. This includes the domain names of all visitors to the Verifone website, and we also use third-party web analytics services that may collect information like your IP address, browser type, operating system, device identifier, geographical area, referring URLs, and other technical information through the use of cookies and similar tracking technology. In some countries or locations (e.g., California), some of this information may be considered personal information under applicable data protection laws.

Collecting this information enables us to better understand the visitors who come to our websites, where they come from, and what content on our websites is of interest to them. We use this information for our internal analytics purposes and to improve the quality and relevance of our websites to our visitors. Some of this information may be collected using cookies and similar tracking technology. You can set your browser to block, delete previously stored cookies, or alert you about these cookies, but some parts of the site may become inaccessible or will not function properly.

Information we collect from third parties

From time to time, we may receive Personal Information about you from third party sources (including resellers, distributors, banks, credit agencies, risk management service providers, couriers, identify verification, and other third parties that sell, service or support Verifone products or solutions), but only where these third parties are legally permitted or required to disclose your Personal Information to us. The types of information we may collect from third parties include identifiers and contact details, billing information, business history, business registration, and delivery details. We use the information we receive from these third parties to provide the requested product, service, or solution.

2. Purposes of Collection and Use of Personal Information

In general, we will use the Personal Information we collect from you only for the purposes described in this Notice or for similarly compatible purposes, or for purposes that we explain to you at the time we collect your Personal Information.

In particular, we will use your Personal Information for our legitimate business and commercial purposes, including to:

  • Provide the products, services, or solutions you purchase, to carry out the terms of our agreements with you and to manage our business relationship (e.g., processing and fulfilling orders and transactions);
  • Maintain and service your account (including activating, registering, or updating products you have purchased from us, e.g., payment terminal);
  • Provide customer service (including sending important notices regarding our terms, conditions, and policies; informing you of upcoming events, updates, news, and the latest product, service, solution, and other offerings where this is in accordance with your communications preferences);
  • Improve, upgrade, and enhance our service (including developing new products and services and analyzing our products);
  • Conduct auditing and due diligence (including credit reference checks, identity verification, and other financial due diligence);
  • Perform accounting, auditing, billing reconciliation, and collection, and other internal business functions;
  • Undertake internal research for technological development (including performing data analysis and processing, market and consumer research, customer satisfaction research, trend analysis, and financial analysis);
  • Undertake activities to verify and maintain the quality and safety of our products, services, and solutions;
  • Detect security incidents and protect against malicious, deceptive, fraudulent, or illegal activity (including protection against fraud and other unlawful activity, claims and other liabilities; establishing, exercising, and defending legal rights; complying with our legal and regulatory obligations under applicable law; and maintaining the physical security of our premises and electronic security);
  • Operate and manage our websites and perform debugging to identify and repair errors;
  • Provide SMS-based Petroleum and Fuel Station customer care (US only): including sending service messages (e.g., help links), responding to your inquiries, and maintaining consent and opt-out records.
  • To comply with legal and regulatory obligations, not limited to complaint handling; and
  • Other short-term transient use.

We may also use your information in an anonymized, de-identified or aggregated manner that does not enable identification of any individual customer to evaluate and improve our offerings.

3. Legal Basis for Processing Personal Information

We use your Personal Information only when we have a valid legal basis to do so. Our legal basis for collecting and using Personal Information will depend on the Personal Information concerned, the circumstances, the specific purpose for which we collected or requested it, and the applicable jurisdiction (e.g., place of collection).

However, we will generally collect Personal Information from you only where:

  • we have your consent to do so;
  • we need the Personal Information to provide payment terms, to provide a product, service, or solution, or to perform a contract or agreement with you, or to take steps at your request before entering into such a contract;
  • we need to protect your vital interests or those of other persons; we
  • we need to comply with legal obligations such as anti-money laundering and counter-terrorist financing legislation. In such situations, we may use and process personal data about you from publicly available sources, credit reference or fraud prevention agencies, or check data against government sanction lists, either directly, or using identity verification providers or due diligence and screening information providers, as necessary to confirm your identity and prevent fraudulent activities and money laundering; or
  • we believe the processing is in our, or others' legitimate interests, taking into consideration your own interests and rights (unless we have your consent or are otherwise required or permitted to by law).

In some cases, we may also have a legal obligation to collect Personal Information from you or may otherwise need the Personal Information to protect your vital interests or those of another person.

4. Personal Information We Share

We may disclose your Personal Information to the following categories of recipients, including for the business purposes described above:

  • To the Verifone group of companies, third-party service providers, and partners who provide data processing services to us or who otherwise process Personal Information for purposes that are described in this Notice or as communicated to you when we collect your Personal Information. Service providers and partners include repair or installation, banks, helpdesk, anti-fraud services, credit agencies, risk management service providers, resellers or distributors, debt-collection agencies, couriers, platform providers, SMS aggregators, and wireless carriers who assist us in delivering mobile messages, contract manufacturers, and product suppliers.   • To any competent law enforcement body, regulatory, government agency, court or other third party where we believe disclosure is necessary or permitted (i) as a matter of applicable law or regulation, (ii) to exercise, establish protect, or defend our legal rights or property, (iii) protect against any legal liability, or (v) to protect your vital interests or those of any other person;
  • In connection with any proposed purchase, merger, reorganization, acquisition, dissolution, or liquidation of any part of our business, provided that we inform the third party that it must use your Personal Information only for the purposes disclosed in this Notice; and
  • To any other person with your specific consent to the disclosure.

For the SMS-based customer care,we do not sell or share mobile numbers, SMS originator opt-in data, or consent/opt-out records for marketing or promotional purposes. We may disclose this information only to service providers acting on our behalf to operate the SMS-based customer care and under contracts prohibiting marketing use.

5. Data Retention

Your Personal Information is retained in a manner consistent with applicable law and for as long as necessary to fulfil the purposes of collection described in this Notice. Records are kept by Verifone and its third-party service providers for varying periods, generally ranging from 1 year to 10 years (and for longer in some cases), depending on the legal, regulatory, or business requirements for the particular record. The criteria used to determine these retention periods include, but are not limited to the following:

  • The length of time we have an ongoing relationship with you and provide the services to you (for example, for as long as the customer has an account with us or keeps using the services);
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time after the customer no longer has an account with us for Tax or Accounting purposes);
  • Whether retention is advisable considering our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations);
  • Whether our operational needs require maintaining your Personal Information (for example, for internal or external audits of company operations, maintaining solicitation preferences (including for former customers and non-customers), systems administration, or for fraud prevention).

When we have no more legitimate business need to process your Personal Information, we will either delete or anonymize it, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

We retain SMS consent and opt-out (STOP) records and related messaging logs for as long as necessary to operate the service or solution, comply with legal or carrier requirements, and resolve disputes, after which we delete or anonymize them.

6. Data Security

While no data security system can fully protect Personal Information from unauthorized data breaches, we have implemented appropriate legal, technical, physical, and organizational security measures in an effort to prevent the loss, misuse, unauthorized access, disclosure, alteration, or destruction of Personal Information.

We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

Because submissions of information over the Internet are never entirely secure, we cannot guarantee the security of information you submit via the Internet, and such submissions are made at your own risk.

7. Your Rights and Choices

Your rights and choices with respect to your Personal Information will depend on the applicable law of your jurisdiction. Depending on the jurisdiction, you may have the right to request access to Personal Information that we hold about you by filling out the Personal Information Rights Request Form.

We will provide access to your Personal Information in the form you want it, where it's reasonable and practical, and does not adversely impact the privacy rights of others. If meeting your request requires significant resources, we may charge a small fee to cover our costs when giving you access, but we'll always check with you first.

Failure to provide Personal Information may result in Verifone being unable to provide or to continue providing services where Personal Information is necessary for such provision.

How to exercise these rights

You can request access to or deletion of your Personal Information or the Personal Information of your household by submitting a request to us by email at: privacy@verifone.com or calling us at: 1.800. Verifone (837.4366). To protect the security of your Personal Information, we will require you to provide us with identifying information for you or your household such as email address, telephone number, a description of the product or service you purchased or inquired about, and/or other information that we can match with the Personal Information we have collected about you or your household to verify your identities.

You may use an authorized agent to request access to or deletion of your Personal Information or the Personal Information of your household. We will require your authorized agent to provide us with either (1) a power of attorney authorizing the authorized agent to act on your behalf or (2) your written authorization permitting the authorized agent to request access to your Personal Information on your behalf or your household. Further, we will require you or your authorized agent to provide us with identifying information to verify your identity and/or the identities or your household members.

To stop receiving SMS-based Petroleum and Fuel Station customer support (U.S. only), reply STOP to our SMS number. This SMS opt-out is specific to text messages and does not change your preferences for other communication channels.

8. Unsubscribe from Our Mailing Lists

If you do not want to receive marketing and sales materials from us, you also have the right to opt out of marketing communications we send you. You can do so by clicking on the "unsubscribe" or "opt-out" link in the marketing communication we send you, by sending your request to privacy@verifone.com, or by submitting a written request using our contact details listed below. We will comply with your request within a reasonable period of time after receiving it or within the time period required by local law.

9. International Personal Information Transfers

Your Personal Information may be transferred to, and processed in, other jurisdictions outside the countries where you reside. These countries may have data protection laws that are different from the laws of your country (and, in some cases, may not be as protective). For example, our website servers are located in the United States, and our third-party service providers and affiliates operate around the world. This means that when we collect your Personal Information, we may process it in any of these locations. Where the SMS-based Petroleum and Fuel Station customer support is used, messaging data may be processed or routed through telecommunications providers in other jurisdictions, and we apply appropriate safeguards consistent with this Notice.

You may have a right under applicable law to make a complaint if you think we have not adhered to this Notice or any applicable privacy law in handling your Personal Information. If you would like to make a complaint, please submit your complaint in writing to the contact details below. We will respond to a written complaint within 30 days. If you are not satisfied with our response, you may be able to pursue your complaint with your data protection authority or privacy commissioner for your country.
