Supplemental Terms - PayPal & Venmo APM Service

These Supplemental Terms for the PayPal & Venmo APM Service supplement and are to be read together with Verifone’s Standard Terms and Conditions and the Supplemental Terms - Verifone’s APM Platform.

Additional Terms Relating to Use of PayPal & Venmo APM Services

(a)  General.  The PayPal & Venmo APM Services ("PayPal Services") are provided by PayPal, Inc., a Delaware corporation (“PayPal”), and its affiliates. PayPal is an independent third party not affiliated with Verifone.  The PayPal Services enable registered users of certain of PayPal’s digital payment applications, as determined by PayPal, (“PayPal Users”) to pay for purchases at Merchant’s enabled locations via the scanning of a machine-readable format (such as barcode, QR code, or other technology capable of storing or accessing data).  PayPal’s PayPal and Venmo mobile applications are currently supported for use with the APM Platform by PayPal.

(b)  Scheme Rules.  Refer to PayPal’s website at www.paypal.com (as may be updated from time to time by PayPal) for information regarding PayPal and its policies and procedures regarding the PayPal Services, including (i) PayPal’s Purchase Protection Program, currently available at www.paypal.com/us/webapps/mpp/ua/useragreement-full) and (ii) PayPal’s Acceptable Use Policy (currently available at https://www.paypal.com/us/webapps/mpp/ua/acceptableuse-full. Merchant is responsible for using the PayPal APM Services in accordance with the applicable PayPal Scheme Rules and may be responsible for claims by PayPal Users as described in the PayPal Scheme Rules, including refunds for Items not Received and items Significantly Not as Described.

(c)  Initiation and Processing of PayPal Transactions.  Transactions can currently be initiated via the PayPal Services by the PayPal User scanning a code generated on a Supported Device Model on its mobile device, in which case the Transaction data will be transmitted via the PayPal User’s service network.  PayPal will provide its authorization or declination to Verifone via the Verifone APM Platform, which will then be transmitted to your Supported Device Model. PayPal and Verifone may, at their discretion, enable PayPal Transactions via other technology and methods in the future.

(d)  Commercial Entity Agreements.  By accessing the PayPal Services, you accept the “commercial entity agreements” required by Visa, MasterCard, American Express, and/or Discover payment card network or any other payment network, which are currently available at www.paypal.com/us/webapps/mpp/ua/ceagreement-full.
